Welcome to Black Justice Hub (the “Platform” or “Hub”), owned and operated by Black Legal Action Centre (“BLAC”). By accessing, browsing, or using this Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy. If you do not agree to these terms, please do not use this Platform.

1. Scope of Agreement and Purpose

The Hub is an online resource platform designed to provide legal informational resources, templates, toolkits, and educational materials to legal professionals (lawyers, paralegals, and law students) and social justice advocates to combat anti-Black racism. By identifying raising and arguing systemic anti-Black racism by identifying, raising and arguing anti-Black racism issues in legal proceedings.

2. No Lawyer-Client Relationship

  • For General Users: The information provided on this Hub is for general informational and educational purposes only. It does not constitute legaladvice. Your use of this Platform, or your transmission of information or emails through it, does not create a lawyer-client or solicitor-client relationship between you and BLAC. If you require legal assistance, you must seek independent legal counsel.
  • For Legal Professionals: The resources, templates, and precedents provided on this Platform are meant to serve as a supplementary reference tool. Legal professionals maintain sole professional responsibility for verifying the accuracy, current status, and applicability of any resource before using it in practice.

3. Disclaimer of Warranties and Limitation of Liability

  • “As-Is” Basis: This Platform and all resources contained herein are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied, including the implied warranties of fitness for a particular purpose or non-infringement.
  • No Guarantee of Currency: While BLAC makes reasonable efforts to keep information up to date, legal statutes and case law evolve rapidly. BLAC does not warrant that the information on the Platform is error-free, complete, or current.
  • Limitation of Liability: To the maximum extent permitted by law, BLAC, its directors, employees, or volunteers shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of, or inability to use, the Platform or its contents.

4. Indemnification

You agree to indemnify, defend, and hold harmless BLAC, its directors, staff, and volunteers from any claims, liabilities, losses, damages, and expenses (including reasonable legal fees) arising out of your violation of these Terms of Use or your misuse of the Platform’s contents.

5. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario and the Federal laws of Canada applicable therein. Any legal action or proceeding relating to your access to, or use of, the Platform shall be instituted in a court in Canada.

6. Modifications to Terms

BLAC reserves the right to modify these Terms of Use at any time. Changes will be posted directly to this page with an updated “Last Updated” date. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

7. Intellectual Property Rights

All content, materials, and resources available on the Hub, including but not limited to text, graphics, logos, toolkits, and templates, are the intellectual property of BLAC or its licensors. They are protected by Canadian and international copyright laws. You are granted a limited, non-exclusive, and non-transferable license to access and use these resources for your personal, non-commercial, educational purposes, consistent with the Hub’s purpose. You may use these documents in whole or any part thereof in legal proceedings. You may not reproduce, modify, distribute, or create derivative works from any content on the Hub for commercial purposes without the express prior written consent of BLAC. Any unauthorized use of intellectual property may result in the termination of your access to the Hub and may subject you to legal action.

8. Rules of Use and User Conduct

By using the Hub, you agree to comply with the following rules. You will not:

  • Abuse the Platform: Use the Hub in any way that may damage, disable, overburden, or impair it, or interfere with any other party’s use and enjoyment of the Hub.
  • Contravene Laws: Use the Hub for any unlawful purpose or in violation of any applicable municipal, provincial, or federal law, regulation, or rules.
  • Misuse Resources: Use the Hub’s resources for any commercial purpose or in any manner that constitutes a breach of the “Intellectual Property Rights” clause.
  • Harm Others: Transmit or upload any material that is defamatory, harassing, discriminatory, abusive, or otherwise objectionable.

9. Termination of Access

BLAC reserves the right, in its sole discretion, to suspend, restrict, or terminate a user’s access to the Hub at any time, with or without notice, where BLAC believes the user has violated these Terms of Use or where such action is necessary to protect the Hub, its users, or its operations.

10. Third-Party Links

The Hub may contain links to external, third-party websites or referral resources. BLAC is not responsible for the content, accuracy, privacy policies, or practices of any third-party sites, and the inclusion of any link does not imply endorsement by BLAC.
